1. A közalkalmazottak jogállásáról szóló 1992. évi XXXIII. Törvény (Kjt.) 21. § (2) bekezdése, valamint a 49/1993. (III.26.) Kormányrendelet (Kjt. V.) 6. §-ában foglaltak alapján – mint alapvető munkáltatói jogokat gyakorló vezető – kinevezem Önt az MTA Rényi Alfréd Matematikai Kutatóintézet közalkalmazotti állományába tudományos tanácsadó munkakörbe.

2. A kinevezés az Európai Közösség által kiírt pályázati eljárásban elnyert határozott idejű szerződéses kutatómunka céljából határozott időre 2007. 02. 19.-tól 2007. 03. 18.-ig szól.

A kinevezés kombinatorikai kutatás feladat elvégzésére szól. A(z) Európai Bizottság által jóváhagyott és elfogadott pályázat, illetve a megkötött szerződés száma: MTKD-CT-2004-003006 A kutatóképzési tevékenységet Győri Ervin felügyeli.

3. Egyidejűleg besorolom a 308420 közalkalmazotti osztályba tartozó J fizetési osztályba. Fizetési fokozatának száma: 15 A besorolásnál a munkakör ellátásához szükséges, hiteles okmányokkal igazolt matematikus végzettségét, munkaviszonyban töltött, illetve egyéb beszámítható idejének 9/14/1962 kezdő időpontját vettem figyelembe.

4. Havi illetményét és illetménypótlékait – a Kjt.-ben és a 49/1993. (III. 26.) Kormány-rendeletben (Kjt. V.-ben) foglalt szabályokra, valamint a MTKD-CT-2004-003006 számú szerződésre való tekintettel – az alábbiak szerint állapítom meg:

Havi illetmény: 1000000 Ft

A közalkalmazott illetményéből és egyéb járandóságából a magyar törvényi előírásoknak, a vonatkozó kettős adóztatás elkerüléséről szóló egyezménynek és az Európai Közösségben érvényes rendelkezéseknek megfelelően levonásra kerülnek a személyi jövedelemadó és az egyéni járulékok.

A járandóság megállapításakor alkalmazott árfolyam: xxx HUF = 1 EUR Az utolsó havi számfejtésnél az árfolyam változásának megfelelően a járandóság korrigálásra kerül, hogy a közalkalmazott által megkapott összeg megfeleljen a MTKD-CT-2004-003006 számú szerződésben meghatározott összegnek.

A közalkalmazott a 2. pontban leírt munka elvégzéséért más járandóságra nem jogosult.

5. A közalkalmazott éves szabadság járandósága a Kjt-ben meghatározott módon kerül meghatározásra és kiadásra, és a magyar közalkalmazottakkal azonos módon jogosult társadalombiztosítási szolgáltatások igénybevételére.

6. A munkavégzés helye: MTA Rényi Alfréd Matematikai Kutatóintézet

7. Kinevezésével létrejött közalkalmazotti jogviszonyával kapcsolatos üzleti titkok: nincsenek

8. Munkaideje: havi 173 óra
Munkarendje: kötetlen.

9. A közalkalmazott tudomásul veszi, hogy köteles:

- Teljes munkaidejét a 2. pontban leírt munka elvégzésére fordítani;

- a munkáját a kutatóintézetben foglalkoztatott közalkalmazottaktól elvárható szakértelemmel és gondossággal, a munkájára vonatkozó szabályok, előírások és utasítások szerint végezni;

- munkatársaival együttműködni, és munkáját úgy végezni, valamint általában olyan magatartást tanúsítani, hogy az más egészségét és testi épségét ne veszélyeztesse, munkáját ne zavarja, anyagi károsodását vagy helytelen megítélését ne idézze elő;

- munkája ellátása során a szakmai szokásokat, valamint a munkáltatója utasításait figyelembe venni;

- munkáját személyesen ellátni

- a lehető leggyorsabban értesíteni a szerződő felet minden olyan eseményről (pl. betegség vagy terhesség), ami befolyásolhatja a szerződés vagy a projekt teljesítését

A kutató vállalja, hogy:

- kitölti, aláírja és eljuttatja a szerződő félhez a 2. pontban említett szerződés III.2 cikkely r), illetve s) pontjában említett kérdőíveket

- a projekt végétől számított három évig értesíti a szerződő felet elérhetőségének megváltozásáról

- a 2. pontban említett szerződés III.4 cikkelyének megfelelően minden, a projekthez kapcsolódó publikációban megemlíti az Európai Közösség Marie Curie programjától kapott támogatást.

A 9. pont kötelezettségei alól kivételt képez, ha alapos személyes vagy családi ok miatt a Bizottság ez alól felmentést ad.

10. A szerzői jogokkal, korábban már meglévő know-howval, az ismeretek felhasználásával, a nyilvánossággal és a titoktartással kapcsolatos kérdésekben a közalkalmazottra az MTA Rényi Alfréd Matematikai Kutatóintézet szerzői jogi szabályzatában foglaltak vonatkoznak; az ebben nem rendezett kérdésekben a MTKD-CT-2004-003006 számú szerződés az irányadó.

11. A közalkalmazott tudomásul veszi, hogy munkáltatói felmentés esetén a Kjt. 33. § (1) bekezdésében megállapítottak szerint számított felmentési idő illeti meg.

12. A jelen kinevezésben nem szabályozott kérdésekre a Munka Törvénykönyvében, a Kjt.-ben és a Kjt. V.-ben, valamint a kapcsolódó jogszabályi rendelkezésekben és a munkáltató kollektív szerződésében foglaltak az irányadók.

1. Pursuant to Section 21 (2) of Act No. XXXIII of 1992 on the Status of Public Servants (the “Act”) and Section 6 of Government Decree 49/1993 (III.26.) (the “Decree”), as the manager exercising basic employer’s rights, I hereby appoint you (the “researcher”) for the position of scientific advisor as a public servant at the HAS Alfréd Rényi Institute of Mathematics.

2. The appointment shall be for a fixed term from 2007. 02. 19. until 2007. 03. 18. for the purposes of fixed term contracted research work won under the terms of the European Community’s 6^th Framework Programme

The appointment is for performing the work/task of research in combinatorics. No. of the concluded contract approved and accepted by the European Community is: MTKD-CT-2004-003006. Research training activities are to be supervised by Győri Ervin

3. Simultaneously, I hereby classify you into salary level 308420 in public servant classification J Your salary level shall be 15

When determining your classification, I took into consideration your degree Master of Sciences in Mathematics and your time spent in employment as well as other includable time as of 9/14/1962

4. In light of the provisions of the Act, the Degree and the contract mentioned under 2., I have determined your monthly salary and salary supplements as follows:

Monthly allowance: HUF 1000000

Personal income tax and other dues shall be duly deducted from the public servant’s salary and salary supplements in accordance with the Hungarian statutory provisions, treaties on avoiding double taxation and European Community regulations.

The salary is determined at the exchange rate: 1 EUR = xxx HUF. The amount received by the researcher shall be corrected in accordance with any changes in the exchange rate in the last month’s payroll, so that the researcher receives the amount that is due to her/him according to Contract No MTKD-CT-2004-003006.

The researcher for his/her research transfer of knowledge activities pursuant to point 2. of this contract is not allowed to receive other incomes than the ones mentioned above.

5. The researcher’s annual leave shall be defined and granted in accordance with the provisions of the Act.

7. Trade secrets related to the public servant legal relationship created as a result of your appointment: none

8. Working hours: 173 hours monthly, flexible schedule

9. The researcher acknowledges that (s)he shall:

- devote him/herself full-time to his/her research transfer of knowledge activities;

- appear at the required place and time in a condition suitable for performing work and spend his/her working hours at work and be available to the employer during this time for the purpose of performing work;

- perform his/her work with the degree of expertise and care that can be expected of the public servants employed by the research institute, in compliance with the rules, requirements and instructions applicable to his/her work;

- cooperate with his/her co-workers, perform his/her work, and generally conduct him/herself in a manner such as not to endanger the health and physical well-being of others, not to disturb their work and not to cause material damage or their inappropriate judgement;

- consider the professional standards and the employer’s instructions during the performance of his/her work;

- perform his/her work personally;

- inform the other contracting party as soon as possible of any circumstances likely to have an effect on the performance of the contract or the project (such as illness or pregnancy).

The researcher agrees to:

- fill out, sign and provide to the other contracting party the forms mentioned in sections r) and s) of Article III. 2 of the contract mentioned under 2.

- inform the other contracting party of any changes in his/her contact information during the three year period following the completion of the project;

- mention in all publications related to the project the support of the Community under the Marie Curie Programme, in accordance with Article III. 4 of the contract mentioned under 2.

The obligations set forth in this Section 9 shall be waived if the Committee grants a waiver from such obligations due to well-founded personal or family reasons.

10. Issues concerning intellectual property rights, in particular the access to pre-existing know-how, the use of knowledge, publicity and confidentiality are regulated in Rényi Institute’s internal intellectual property regulations, which is compatible with the provisions of the contract mentioned under 2; issues not regulated by the internal rules are governed by the contract mentioned under 2.

11. The researcher acknowledges that in the event of discharge by the employer, he shall be entitled to a discharge period as defined in Section 33 (1) of the Act.

12. All issues not regulated by this Appointment shall be governed by the Labour Code, the Act, the Degree and the related statutory provisions, as well as the employer’s Collective Agreement.
